McMurray was charged with vehicular assault and booked into the Wilson County Jail. He was released a short time later after posting a bond of $40,000.

Assistant District Attorney Linda Walls said the case remains under investigation and that other charges could be filed.

She noted that McMurray could have been charged with DUI, a misdemeanor, but because of the nature of the case, a more serious charge of vehicular assault was filed instead.

Brooks, who suffered serious injuries, remains in Vanderbilt University Medical Center.

Bragg, in his report, said none of the three were wearing seat belts at the time of the accident.

All three, Roper, McMurray and Brooks, graduated from Wilson Central High School. McMurray and Brooks were active in sports and played on the football and basketball teams.
