Healthcare, firearms legislation filed

Wilson County legislators have been busy on Capitol Hill in Nashville as the Tennessee General Assembly went into session on Monday.

District 17 State Sen. Mae Beavers, R-Mt. Juliet, and District 46 State Rep. Mark Pody, R-Lebanon, filed legislation to prohibit the state from implementing the Affordable Care Act, or Obamacare.

They announced the legislation during a press conference on Wednesday.

The measure would not allow cooperation between the state in putting into place and managing the federal health care law.

The measure prohibits new health insurance exchanges that are part of the ACA.

They noted they had not discussed the legislation with anyone in Gov. Bill Haslam’s administration or anyone with the state’s Medicaid program TennCare which offers health care for more than 1 million citizens.

The bill is named “The Health Care Freedom and Affordable Care Act Noncompliance Act. It is Senate Bill 1680 and may be found on the General Assembly’s website at

Beavers also introduced SB 1607, “The Tennessee Firearms Freedom Act,” an expansion of the 2009 act.

The 2014 version, a news release from the Tennessee Firearms Association said, “declares that the States expressly prohibits the federal government from having any regulatory authority over firearms in Tennessee based on the 2nd and 10th Amendments in the Bill of Rights. As a result no federal firearms laws in Tennessee are valid. The first provision of the bill will mandate criminal penalties for any federal or state official attempting to enforce unconstitutional federal firearms laws within the borders of Tennessee. The second provision empowers citizens to pursue claims by defining federal firearms laws as intentional civil rights violations.”

A sponsor for the bill in the House, the news release said, is to be announced in a few days.
